Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website at https://stumptownpainters.com and any related services (the "Service") operated by Stumptown Painters ("Stumptown Painters," "we," "us," or "our"). By using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. What we are

Stumptown Painters is a residential painting lead marketplace serving the Portland, Oregon metropolitan area. We are not a painting contractor. We do not perform painting work, employ painters, supervise jobsite work, or warrant the work performed by any contractor who purchases your lead through our marketplace. We facilitate introductions between homeowners and licensed Oregon painting contractors.

2. Eligibility

You must be at least 18 years old and a resident of Oregon (for homeowners) or a licensed Oregon painting contractor (for contractors) to use the Service.

3. Homeowner submissions

When you submit a quote request, you represent that the information you provide is accurate and complete, that you are the homeowner of the property or have authority from the homeowner to request work at the property, and that you consent to be contacted by Stumptown Painters and by the participating contractor we match you with regarding your request, in accordance with our Privacy Policy and the SMS terms below.

4. Contractor terms

Contractors who register on the Service must (a) hold a valid Oregon Construction Contractors Board (CCB) license, (b) maintain a Google Business Profile with at least 4.0 star rating and 10 or more reviews, and (c) accept the additional Contractor Terms presented at registration. Contractors agree not to contact homeowners outside of paid lead purchases, to respond to purchased leads within 24 hours, and to handle disputes per our published refund and dispute policy. Lead purchases are non-refundable except as set out in our Refund Policy.

5. SMS messaging program

Stumptown Painters sends transactional and account-related SMS messages to homeowners and contractors who have explicitly opted in. Message types, frequency, opt-out instructions (reply STOP), help instructions (reply HELP), and our no-third-party-sharing commitment for SMS opt-in data are described in detail in our Privacy Policy. Message and data rates may apply. Consent is not a condition of any purchase.

6. Payments

Lead purchases are processed by Stripe. By completing a purchase you authorize the charge to the payment method you provide. Prices are stated in U.S. dollars. Promotional discounts (such as the new-contractor 10 percent discount) apply only when the relevant conditions are met and the discount is unexpired.

7. Acceptable use

You agree not to:

  • Submit false, misleading, or fraudulent quote requests, or attempt to scrape, spam, or otherwise abuse the Service.
  • Use the Service to solicit or recruit contractors outside of our marketplace.
  • Resell, repackage, or redistribute leads obtained through the Service.
  • Reverse engineer, decompile, or attempt to extract source code from the Service.
  • Violate any applicable law, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, or any state-level consumer protection law.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTY REGARDING THE QUALITY, RELIABILITY, OR LEGAL COMPLIANCE OF ANY CONTRACTOR WHO PURCHASES YOUR LEAD. YOU ARE RESPONSIBLE FOR INDEPENDENTLY VERIFYING ANY CONTRACTOR'S LICENSURE, INSURANCE, AND REPUTATION BEFORE HIRING.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STUMPTOWN PAINTERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

10. Indemnification

You agree to defend, indemnify, and hold harmless Stumptown Painters from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service, (b) your breach of these Terms, or (c) your violation of any law or third-party right.

11. Governing law and venue

These Terms are governed by the laws of the State of Oregon, without regard to conflicts of law principles. Any dispute arising from or related to these Terms or the Service will be resolved exclusively in the state or federal courts located in Multnomah County, Oregon, and you consent to personal jurisdiction in those courts.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and without prior notice. The sections of these Terms that by their nature should survive termination will survive (including, without limitation, disclaimers, limitation of liability, indemnification, and governing law).

13. Changes to these terms

We may update these Terms from time to time. Material changes will be communicated through the Site, and the Effective date at the top will be updated. Continued use of the Service after a change means you accept the updated Terms.
